ಪ್ರಧಾನಿ ಮೋದಿ ಕುರಿತಾದ ಬಿಬಿಸಿ ಸಾಕ್ಷ್ಯಚಿತ್ರವನ್ನು ಕೇಂದ್ರ ಸರ್ಕಾರ ಹೇಗೆ ನಿಷೇಧಿಸಿತು ಎನ್ನುವ ಬಗ್ಗೆ ಟಿಎಂಸಿ ನಾಯಕ, ಆರ್‌ಟಿಐ ಕಾರ್ಯಕರ್ತ ಸಾಕೇತ್ ಗೋಖಲೆ ಅವರು RTI ಮೂಲಕ ಮಾಹಿತಿ ಪಡೆದುಕೊಂಡು ಟ್ವಿಟ್ ಮಾಡಿದ್ದಾರೆ.
“ಭಾರತ: ಮೋದಿ ಪ್ರಶ್ನೆ” ಎಂಬ ಬಿಬಿಸಿ ಸಾಕ್ಷ್ಯಚಿತ್ರವನ್ನು ಮೋದಿ ಸರ್ಕಾರವು ಯಾವುದೇ ಕಾರಣಗಳನ್ನು ನೀಡದೆ ಜನವರಿ 2022 ರಲ್ಲಿ ನಿಷೇಧಿಸಿತು. ಹಾಗಾಗಿ ಕಾರಣವನ್ನು ಕಂಡುಹಿಡಿಯಲು ನಾನು RTI ಅನ್ನು ಸಲ್ಲಿಸಿದೆ ಮತ್ತು ವಿಲಕ್ಷಣವಾದ ಉತ್ತರವನ್ನು ಸ್ವೀಕರಿಸಿದೆ” ಎಂದು ತಿಳಿಸಿದ್ದಾರೆ.
How Modi Govt illegally banned the BBC documentary on PM Modi:
A BBC documentary on PM Modi called “India: the Modi Question” was banned by Modi Govt in Jan 2022 without giving any reasons.
So I filed an RTI to find out the reason & received a bizarre reply.

”ಪ್ರತಿಕ್ರಿಯೆಯಾಗಿ, ಮಾಹಿತಿ ಮತ್ತು ಪ್ರಸಾರ ಸಚಿವಾಲಯವು IT ನಿಯಮಗಳು 2021ರ ನಿಯಮ 16ರ “ಇಂಟರ್ ಡಿಪಾರ್ಟ್ಮೆಂಟ್ ಕಮಿಟಿಯ (IDC) ಶಿಫಾರಸುಗಳ” ಆಧಾರದ ಮೇಲೆ ಸಾಕ್ಷ್ಯಚಿತ್ರವನ್ನು ನಿಷೇಧಿಸಲಾಗಿದೆ” ಎಂದು ಹೇಳಿದೆ.
In response, Ministry of I&B tells me that the documentary was banned based on Rule 16 of the IT Rules 2021 on "recommendations of Inter Departmental Committee (IDC)."

IDC ಕೇವಲ ಶಿಫಾರಸುಗಳನ್ನು ಮಾತ್ರ ನೀಡಬಹುದು, ಆದೇಶಗಳನ್ನು ನೀಡುವುದಿಲ್ಲ” ಎಂದು ಹೇಳಲಾಗುತ್ತದೆ.
👉 Rule 16 allows @MIB_India to block digital content "in cases of emergency" only
👉 After that the Ministry is required to constitute an inter-departmental committee (IDC) to review the ban
👉 The IDC can issue ONLY RECOMMENDATIONS and NOT ORDERS.

”ಐಟಿ ನಿಯಮಗಳ ನಿಯಮ 17 ಏನು ಹೇಳುತ್ತದೆ ಎಂಬುದನ್ನು ಗಮನಿಸಿ, ಸಮಿತಿಯು ಉಲ್ಲೇಖಿಸಿದ ದೂರುಗಳು ಮತ್ತು ಶಿಫಾರಸುಗಳನ್ನು ಒಳಗೊಂಡಂತೆ ಸಮಿತಿಯ (IDC) ಪ್ರಕ್ರಿಯೆಗಳ ಸಂಪೂರ್ಣ ದಾಖಲೆಗಳನ್ನು ಸಚಿವಾಲಯ ನಿರ್ವಹಿಸುತ್ತದೆ. ಆದ್ದರಿಂದ, IDC ಯ ಪ್ರಕ್ರಿಯೆಗಳು RTI ಕಾಯಿದೆ ಅಡಿಯಲ್ಲಿ ಸಾರ್ವಜನಿಕ ದಾಖಲೆಗಳಾಗಿವೆ” ಎಂಬುದು ತಿಳಿದುಬಂದಿದೆ.
Also note that Rule 17 of IT Rules says that
👉 Ministry shall maintain complete records of proceedings of the Committee (IDC) including complaints referred & recommendations made by the Committee
Therefore, the proceedings of the IDC are PUBLIC RECORDS under RTI Act.

And despite this, @MIB_India refused to tell me the reasons behind banning the BBC documentary on PM Modi because:

”ಪ್ರಧಾನಿ ಮೋದಿಯವರ ವಿರುದ್ಧದ ಟೀಕೆಗಳನ್ನು ಸೆನ್ಸಾರ್ ಮಾಡಲು ತುರ್ತು ಅಧಿಕಾರವನ್ನು ಬಳಸುವ ಸ್ಪಷ್ಟ ಪ್ರಯತ್ನವಾಗಿದೆ. ಮಾಹಿತಿ ಮತ್ತು ಪ್ರಸಾರ ಸಚಿವಾಲಯವು “ಭಾರತದ ಸಾರ್ವಭೌಮತೆ ಮತ್ತು ಸಮಗ್ರತೆಯ” ಆಧಾರದ ಮೇಲೆ ಸಾಕ್ಷ್ಯಚಿತ್ರವನ್ನು ನಿಷೇಧ ಮಾಡಿದೆ ಎಂದು ಹೇಳಲಾಗಿದೆ. ಪ್ರಧಾನಿ ಮೋದಿಯ ಕುರಿತ BBC ಸಾಕ್ಷ್ಯಚಿತ್ರವನ್ನು ಏಕೆ ನಿಷೇಧಿಸಲಾಗಿದೆ? ಮೋದಿ ಏನು ಭಾರತವಲ್ಲ. ಅವರ ಟೀಕೆಯನ್ನು “ಭಾರತಕ್ಕೆ ಬೆದರಿಕೆ” ಎಂದು ನಿಷೇಧಿಸಲಾಗುವುದಿಲ್ಲ” ಎಂದು ಗೋಖಲೆ ಅವರು ಹೇಳಿದ್ದಾರೆ.
An appeal will be filed asking @MIB_India be directed to immediately release the deliberations of IDC & why BBC documentary on PM Modi was banned on grounds of "sovereignty & integrity of India."
Modi is NOT India. His criticism cannot be BANNED as a "threat to India".
